If you are subject to an emergency ERPO, the law enforcement agency who serves the paperwork will take possession of your firearms at the time the order is served upon you. They will be stored at the law enforcement agency for the duration of the order unless an alternative storage location is determined.

If you wish to have the court consider allowing the transfer of your firearms to a federally licensed firearms dealer, you may bring this up at your hearing. Any costs associated with storage will be your responsibility.

If you are subject to a long-term order and are given 24 hours to transfer your firearms to a law enforcement agency or federally licensed firearms dealer, use the forms listed below. You must file these forms with law enforcement, not the court.

If you do not own or possess any firearms, the only form you need to complete is the Declaration of No Ownership or Possession of Firearms (ERP205).
If you are transferring an antique firearm or a firearm classified as a curio or relic to a relative who is legally permitted to possess it, your relative must complete the Affidavit of Transfer of Antique Firearms to Relative (ERP208).
Once you have transferred all firearms you own or possess to a law enforcement agency or a federally licensed firearms dealer, you must complete the Respondent’s Declaration of Transfer of Firearms (ERP206).
Depending on the circumstances of the transfer, you or law enforcement will also need to complete the Proof of Transfer (ERP207).

Submit all completed forms to the responsible law enforcement agency within two business days of transferring the firearms.
